Welcome to Chatroulette. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the Chatroulette website, mobile applications, and any related services (collectively, the "Services"). By accessing, browsing, downloading, or registering to use our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you are strictly prohibited from using the Services.
Chatroulette provides a platform for random, peer-to-peer video and text chat. Given the spontaneous nature of these connections, strict adherence to our community guidelines and safety protocols is mandatory.
1. Eligibility and Age Requirements
You must be at least 18 years of age to access or use Chatroulette.
Chatroulette is strictly an adult-only platform. By using the Services, you represent and warrant that you are 18 years of age or older, and that you have the legal capacity to enter into a binding contract in your jurisdiction. If we discover or have reasonable suspicion that a user is under the age of 18, their account, access, and IP address will be immediately and permanently banned without notice.
2. Acceptable Use and Community Rules
To maintain a safe and respectful environment, you agree to abide by our Acceptable Use Policy. Everywhere in the world, where people come together, there are rules. When using Chatroulette, you must comply with the following:
- Respect Others: You must interact with other users in a polite, respectful manner. We do not tolerate bullying, harassment, intimidation, defamation, sexism, racism, homophobia, or any form of hate speech.
- No Inappropriate or Suggestive Content: Broadcasting, sharing, or soliciting sexually explicit content, pornography, or severe nudity is strictly prohibited on the platform. Violation of this rule will result in immediate termination of access.
- No Illegal Activities: You may not use the Services to engage in, promote, or facilitate any illegal activity. This includes, but is not limited to, the sale of illegal goods, severe drug abuse, or the promotion of violence.
- No Impersonation: You may not pretend to be another person, celebrity, or entity. Your video feed must be your own authentic representation. Pre-recorded videos or virtual cameras designed to deceive are not allowed.
- No Spam or Commercial Misuse: You may not use Chatroulette for unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or any other form of solicitation. The platform is not to be used for commercial revenue-generating endeavors.
- No Interference: You must not attempt to disrupt, overburden, or decipher any part of the Services. This includes reverse engineering, scraping, unauthorized data collection, or distributing viruses and malware.
3. Child Safety and Zero-Tolerance Policy
Chatroulette has a zero-tolerance policy regarding any content or behavior that exploits, endangers, or depicts minors. This applies regardless of a user's stated location.
Uploading, streaming, requesting, searching for, or linking to Child Sexual Abuse Material (CSAM) or engaging in grooming behaviors will result in an immediate, permanent ban. Furthermore, Chatroulette actively cooperates with international law enforcement and organizations like INHOPE. All confirmed instances of CSAM or child exploitation are reported to the relevant authorities within 24 hours, and user data is preserved for investigation. There is no appeal process for violations of this policy.
4. AI Screening, Moderation, and Reporting
By using Chatroulette, you explicitly consent to the monitoring and moderation of your interactions on the platform.
- Automated AI Screening: Every video frame broadcast on Chatroulette is analyzed in real-time by purpose-built machine learning models. These models are trained to detect prohibited content (such as nudity or policy violations). If the AI flags a session, the connection is interrupted instantly.
- Human Moderation: We employ a 24/7 Trust & Safety team. Our human moderators review escalated AI flags and user reports. Chatroulette periodically takes encrypted screenshots of video streams for moderation purposes.
- User Reporting: Users have the ability to report others for violating these Terms using the in-app "Report" function. Submitting false or malicious reports may result in the suspension of your own account.
5. The Quids Economy
Chatroulette utilizes an in-app virtual currency system known as "Quids." Quids are used to access premium filters, such as the "Top Users" feature.
Users can earn free Quids by maintaining positive interactions and being selected by other users. Users may also purchase Quids. All sales of Quids are final and non-refundable. Quids have no real-world monetary value, cannot be exchanged for cash, and remain the property of Chatroulette. We reserve the right to modify the pricing, earning rate, or availability of Quids at our sole discretion.
6. Intellectual Property Rights
All content, features, and functionality available on the Services—including but not limited to the Chatroulette name, logos, design, text, graphics, and software—are the exclusive property of Chatroulette or its licensors and are protected by international copyright, trademark, patent, and trade secret laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of our intellectual property without our express written consent. By broadcasting content on Chatroulette, you grant us a temporary license to process and display that content solely for the purpose of operating the Service and conducting safety moderation.
7. Privacy and Data Handling
Your privacy is important to us. Our data collection, usage, and retention practices are detailed in our Privacy Policy. By agreeing to these Terms, you also agree to the terms outlined in our Privacy Policy. Please note that while video streams are primarily peer-to-peer (WebRTC), safety moderation requires temporary processing of visual data. We comply with GDPR and applicable privacy laws regarding data retention.
8. Disclaimers and Limitation of Liability
A. "AS IS" Basis
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Chatroulette makes no representations or warranties of any kind, express or implied, regarding the operation of the Services, the accuracy of the matching algorithm, or the conduct of other users.
B. User Conduct Disclaimer
Chatroulette does not pre-screen all users. You acknowledge that by using the platform, you may be exposed to content that is offensive, indecent, or objectionable, despite our moderation efforts. You use Chatroulette entirely at your own risk. Chatroulette assumes no responsibility for the actions, content, or data of third parties.
C. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Chatroulette, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use, or alteration of your transmissions or content.
9. Indemnification
You agree to defend, indemnify, and hold harmless Chatroulette, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use or misuse of the Services.
10. Modifications to the Terms
Chatroulette reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide notice via an in-app banner or website notification prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chatroulette is headquartered, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in that jurisdiction, and you hereby irrevocably consent to the personal jurisdiction and venue therein.
